What counts as a construction defect?
A construction defect is a flaw in design, materials, or workmanship that makes a house perform worse than it should. Normal wear is something else. A 20 year old water heater failing is age. A brand new one failing because nobody put a pan under it is a defect.
That line matters for your wallet. Defects can fall under a builder warranty or a claim. Wear usually does not.
Three buckets cover most of it:
- Design flaws, like a roof valley that dumps water onto one patch of stucco.
- Workmanship errors, usually meaning something got skipped.
- Site work, mostly grading done before the slab was poured.
Cracks that track diagonally off a door frame usually point to movement, and movement opens gaps that water follows.
Which construction defects cause water damage?
The defects that soak Arizona homes almost always involve the building envelope, the plumbing rough-in, or how water moves across the lot. None of them fail on day one. They fail during the first hard monsoon, or the first time a slow drip finally saturates a wall cavity.
Flashing and envelope gaps
Flashing seals the joints where two surfaces meet. Roof to wall. Window to stucco.
Get it wrong and water walks straight in. Wind driven rain is the real test, and the Insurance Institute for Business and Home Safety studies how rain gets pushed through a building envelope. A calm drizzle proves nothing.

Plumbing rough-in shortcuts
Plenty of intrusion starts with how the pipes went in, not the pipes themselves.
We find supply lines stapled too tight against studs, which wears a hole over the years. Missing drip pans under upstairs washers. Unsleeved slab penetrations, where concrete slowly abrades the pipe.
None of that is dramatic. That’s the problem. A pinhole behind a wall can run for months before anyone notices, and by then the drywall, insulation, and baseboard are gone.
Grading, drainage, and the mold that follows
Your lot should slope away from the foundation. When it slopes toward the house, or a downspout dumps onto flat dirt beside the stucco, moisture wicks in low.

How do the same defects create fire risk?
Fire risk from construction defects traces back to electrical rough-in shortcuts, missing firestopping, or vent runs that were never built right. The overlap with water is no coincidence. Both live in the same hidden spaces, created by the same trade on the same rushed schedule.
Electrical rough-in shortcuts
Loose connections are the classic. A wire nut that never fully seated creates resistance, resistance makes heat, and that heat cycles for years inside a closed box.
Other regulars: too many circuits in one box, staples driven through cable sheathing, and recessed cans buried in insulation.
Missing firestopping
Firestopping seals the gaps where pipes, wires, and ducts pass through framing. It buys time. Skip it and a small garage fire gets a clear path into the attic. Shared townhome attics are worth a look.
Dryer vents and duct runs
A dryer vent that runs too long, sags between joists, or uses foil instead of rigid metal traps lint. Lint is fuel. It’s one of the most preventable fire causes in a newer home, and it’s an install decision.

Why do new homes hide this for years?
Defects stay hidden because our climate rarely stress tests a house until monsoon season, and by then the warranty window may have closed. Dry air is a mixed blessing. It masks small leaks that would announce themselves fast in a humid state.

What can you check yourself in 10 minutes?
Most homeowners can spot the early evidence of a construction defect without any tools at all. You are not diagnosing anything. You are just looking for signs that something behind a surface is misbehaving. Photograph whatever you find, with dates.
- Scan ceiling corners and the top of exterior walls for faint tea colored rings.
- Press baseboards near tubs and water heaters, and check under every sink for cupped cabinet bottoms.
- After a storm, note where water sits near the foundation.
- Feel outlet plates on busy circuits, then check the attic for daylight or matted insulation.
That record earns its keep in any warranty conversation later.
Paint does not blister on its own. Something behind the finish is wet, and it has been wet for a while.
What should you do if you find damage?
Stop the water if you can, document everything, and get the wet materials assessed before anyone patches over them. Cosmetic repair on top of a soaked cavity is the costliest mistake we see. It buries the problem and restarts the clock.
Three things need to happen, in order: find the source, dry or remove the wet materials, then rebuild.
